Terms of Service

Draft version 0.1 — 25 August 2026 — covers the SamDriver app and SamDriver Association Portal.

This is a draft, not a final policy. It has been prepared to accurately describe how the SamDriver app actually works, based on a direct technical review of the code. It has not yet been reviewed or approved by a South African attorney and should not be relied on as final or legally binding until that review is complete.

These terms govern your use of the SamDriver app and the SamDriver Association Portal, operated by Justice Action Services (Pty) Ltd ("JAS", "we", "us"). By creating an account, you agree to these terms.

1. Eligibility and invitation-only access

SamDriver is not open to the public. You may only create an account using a valid invitation code issued by your taxi association or by JAS. We reserve the right to suspend or close an account created with a code that was not issued to you, or obtained without authorisation.

2. Your account

You're responsible for the accuracy of the information you provide (including your ID, licence, and vehicle details) and for keeping your device and account secure. Let us know if you believe your account has been accessed without your permission.

3. Emergency features are not a substitute for emergency services

The Emergency feature is a tool to help you reach JAS and share your situation quickly — it is not a replacement for South Africa's emergency services. If you are in immediate danger, call 112 (or the relevant emergency number) first.

4. Reports, ratings, and content you submit

When you submit an incident report, hazard report, photo, voice note, or rating, you confirm it's accurate to the best of your knowledge and give us permission to use it to operate the service (for example, showing anonymised hazard reports to other drivers, or using ratings to calculate a driver's score). Driver ratings are shown to the rated driver without revealing who left them.

Don't submit false reports, abusive content, or anything that isn't genuinely yours to share.

5. The fuel calculator and automatic photo reading

The fuel calculator's automatic reading of receipts and odometer photos is provided as a convenience and may occasionally misread a number. You're responsible for checking the figures before saving a record — the app always shows you the reading before it's saved, specifically so you can correct it.

6. Vouchers, benefits, and sponsored content

Vouchers and benefits are provided at the discretion of JAS, your association, and participating sponsors, and are subject to availability. Sponsored content is always clearly labelled as sponsored. We don't guarantee any particular voucher, benefit, or advertised offer will remain available.

7. Feature availability

Features may be turned on or off by JAS or your association from time to time (for example, during maintenance or a policy change), and are not guaranteed to always be available.

8. Not a law firm

Justice Action Services is a claims-facilitation service and is not a law firm. Nothing in the SamDriver app constitutes legal advice. Where legal representation is involved (for example, through JAS's separate RAF claims service), that representation is provided by independent personal-injury attorneys, not by JAS directly.

9. Ending your access

You may stop using the app at any time. We may suspend or close an account that breaches these terms, was created fraudulently, or where your association membership ends.

10. Limitation of liability

[TO CONFIRM: JAS's preferred limitation-of-liability wording — this needs attorney input given the app's safety-adjacent features (Emergency, Road Alerts, hazard reports) and should not be finalised without that review.]

11. Governing law

These terms are governed by the laws of the Republic of South Africa.

12. Changes to these terms

We'll update the date at the top of this page whenever these terms change, and let you know in the app if a change is material.
