2. Guide on how to use PAIA
The South African Human Rights Commission publishes a guide on how to use PAIA, available on its website, which explains the process for requesting access to records held by public and private bodies.
3. Records held by Justice Action Services
Records are generally not made available automatically without a request, except where indicated. Categories of records held include:
- RAF claim intake records collected via SAM (our WhatsApp claims-intake assistant) and the claims process generally;
- SamDriver app records: driver and (where applicable) passenger account information, compliance documents, incident and hazard reports, ratings, and related records — see our Privacy Policy for the full description of what's collected and why;
- Business and financial records in the ordinary course of operating Justice Action Services;
- Correspondence and records relating to sponsors, partners, and service providers.
4. How to request access to a record
A request for access to a record must be made in the prescribed form (Form C1 under PAIA) and directed to the Information Officer using the contact details in section 1. [TO CONFIRM: any specific fee schedule or additional process JAS wants to publish here — PAIA sets standard prescribed fees by default.]
5. Grounds for refusal
Access to a record may be refused only on the grounds set out in PAIA — for example, where a record contains another person's personal information, legally privileged material, or information that would unreasonably prejudice a third party's commercial interests.
6. Related: your POPIA rights
Separately from PAIA access requests, if you're a SamDriver app user, you can request a copy of your personal data or ask for your account to be deleted directly from the app's Settings screen — see our Privacy Policy for details on how your information is used.
